ABOUT THESE TERMS
These Terms and Conditions apply when you use my website, www.elainegemmell.co.uk, or place an order through my online shop.
The website and online shop are owned and operated by Elaine Gemmell. In these Terms, “I”, “me” and “my” refer to Elaine Gemmell, and “you” and “your” rider to anyone using my website or purchasing from me.
Please read these Terms before placing an order. By placing an order with me, you agree to there Terms.
These Terms should be read alongside any information provided on the relevant product page, at checkout, and in my Returns and Damaged/Faulty Goods policies.
PRODUCTS AND PRODUCT INFORMATION
I sell jewellery and accessories through my online shop.
I take care to ensure that product descriptions, photographs and other information on my website are as accurate as possible. Colours may appear differently depending on your computer, phone, tablet or other screen, so I cannot guarantee that the colour displayed on your screen will exactly match the item you receive.
Nothing in these Terms affects your legal rights in relation to the quality, description or suitability of the goods you purchase.
ORDERS
When you place an order through my website, you are making an offer to purchase the goods selected.
Once your order has been received, I will send you an order confirmation by email. This confirms that I have received your order but does not necessarily mean that your order has been accepted.
I reserve the right to refuse or cancel an order in limited circumstances, such as where an item is unavailable, there has been an obvious error in the price or product information, or I reasonably suspect fraudulent activity.
If I need to cancel and order after payment has been taken, I will provide a full refund using the original payment method.
PRICES AND PAYMENT
All prices displayed on my website are shown in pounds sterling and include VAT where applicable.
I currently accept payment by credit and debit card through my payment provider, Stripe.
Your payment details are processed securely by Stripe and are not handled or stored by me.
The price payable for your order is the price shown at the time you place your order.
If I discover an obvious pricing error before your order has been dispatched, I will contact you to explain the error. You will have the option to proceed with the order at the correct price or receive a full refund.
If you are purchasing from outside the UK, you may be responsible for customs duties, import taxes or other charges imposed by the destination country. These charges are outside my control.
DELIVERY
Ready-to-ship orders are usually processed and dispatched within 2-4 working days. Orders are normally dispatched Monday to Thursday.
Bespoke, personalised, altered or made-to-order items may take longer. An estimated timescale will be provided before you place your order.
Orders are sent using Royal Mail Special Delivery unless otherwise stated. A tracking number will be provided once your order has been dispatched.
Delivery times provided by Royal Mail are estimates and may be affected by circumstances outside my control, including delays, adverse weather, strikes or other postal or delivery issues.
You are responsible for providing a complete and accurate delivery address and recipient name when placing your order. I cannot be responsible for delays or loss resulting from incorrect or incomplete information supplied by you.
If an order is returned to me because an incorrect or incomplete delivery address was provided, please contact me so that we can arrange redelivery.
RIGHT TO CANCEL
If you are a consumer in the United Kingdom, you generally have the right to cancel your contract to purchase goods from me within 14 days without giving a reason.
The cancellation period ends 14 days after the day on which you, or someone you nominate other than the carrier, receive the goods.
To exercise your right to cancel, you must inform me of your decision within the cancellation period.

Please include your order number and clearly state that you wish to cancel your order and which item or items you wish to cancel.
You do not have to give a reason for cancelling.
The statutory right to cancel does not apply to goods made to your specifications or clearly personalised, including bespoke items, where the relevant legal exception applies.
EFFECTS OF CANCELLATION
If you cancel your contract, you must return the goods to me without undue delay and no later than 14 days after telling me that you wish to cancel.
You are responsible for the direct cost of returning unwanted goods.
I strongly recommend using a tracked and appropriately insured service when returning jewellery and retaining your proof of postage and tracking information.
If your order has already been dispatched when you contact me to cancel, I may be unable to stop the delivery, You should still notify me of your cancellation and return the goods after receiving them.
I may withhold reimbursement until I have received the goods back or you have provided evidence that you have sent them back.
If the goods have been handled beyond what is necessary to establish their nature, characteristics and functioning, you may be responsible for any resulting reduction in their value.
If you cancel your contract, I will refund the payments I received from you, including the cost of the least expensive standard delivery option offered by me. I am not required to refund any additional amount paid for an upgraded delivery service.
Refunds will be made using the same payment method used for the original transaction.

FAULTY OR DAMAGED GOODS
I want you to be happy with your purchase and I will deal with faulty or damaged goods in accordance with your statutory consumer rights.
If your goods arrive damaged or you believe there is a fault with an item, please contact me at: elainegemmelljewellery@gmail.com
Please provide details of the problem and, where possible, photographs showing the damage or fault. This helps me assess the issue and determine the most appropriate way to resolve it.
Depending on the circumstances and your statutory rights, I may offer a repair, replacement or refund.

Nothing in these Terms limits or excludes your statutory rights.
RETURNS
If you change your mind about a purchase, please follow the cancellation and returns process described above and in my Returns Policy.
Unwanted goods should be returned in accordance with the instructions provided in my Returns Policy.
Goods should be returned in a condition that allows their nature, characteristics and functioning to be established. You may be responsible for any reduction in value resulting from handling beyond what would reasonably be necessary to examine the goods.
Certain goods may be excluded from the statutory right to cancel where a specific legal exception applies, including certain personalised or bespoke goods.

INTELLECTUAL PROPERTY
The photographs, artwork, jewellery designs, written content and other original material on my website belong to me or are used with permission.
You must not copy, reproduce, modify, distribute or use my original content or designs commercially without my written permission.
If you would like to use or reference any of my content, please contact me first.
THIRD-PARTY WEBSITES
My website and blog may occasionally contain links to third-party websites.
These links are provided for information or convenience. I am not responsible for the content, availability or privacy practices of third-party websites, and linking to another website does not mean that I endorse it.

I aim to respond to enquiries within 24 hours, although this may take longer during weekends, holidays or particularly busy periods.
If you are contacting me to cancel an order, you can email me directly. You do not need to use the Contact form.

My blog, “Studio Notes” may contain information about gemstones, crystals and other jewellery-related subjects.
Any information about the traditional or claimed properties of stones and crystals is provided for general interest only and is not medical, therapeutic or professional advice.
I do not endorse the use of crystals or gemstones as a substitute for appropriate medical or professional treatement.
CHANGES TO THESE TERMS
I may update these Terms from time to time.
The Terms that apply to your purchase are the Terms in place at the time you place your order.
The current version will always be available on my website. I may also announce significant changes on my website.
